Family of Boy Injured In Game of Hide-And-Seek Settles Lawsuit

The Olivehurst Public Utility District, Beazer Homes, and the builder of River Park, all from California, settled a lawsuit brought by the family of a twelve year old boy.

The lawsuit alleged that the boy was injured when he collided with a piece of metal protruding from a picnic table that had been vandalized. The collision severely cut his leg leaving a scar.

The boy was engaged in a game of hide-and-seek with playmates when the injury occurred.

Although the defendants dispute the severity of the scar, arguing that it posed no health or cosmetic risk, they decided to settle the suit. The defendants covered the $1,200 in medical bills, but the rest of the settlement remains undisclosed.

IHOP Alleging Liability for Premises Maintenance

A Texas woman sued IHOP after slipping and falling on a slippery ramp leading to the restaurant’s entrance. The lawsuit claims that IHOP should have been aware of the slippery condition of the ramp and should have taken remedial measures to prevent someone from falling.

Moreover, IHOP’s negligence in maintaining the ramp created the harmful condition and the restaurant failed to provide any warning that the ramp may be slippery.

The suit alleges that as a result of the fall, the woman suffered permanent injuries to her knees, back, and elbow and is seeking damages for medical costs, lost earnings, pain and suffering, mental anguish, disfigurement, and impairment.
